Once there was a little girl called Clarissa, she was ten-years-old and she lived in a mental
hospital, because she killed her mom and her dad. She got so bad she went to kill all the
staff in the hospital so the More-government decided that best idea was to get rid of her so
they set up a special room to kill her, as humane as possible but it went wrong the
machine they were using went wrong. And she sat there in agony for hours until she died.

I don't accept point commissions, just USD via Paypal. If you're simply requesting, I don't do requests.

And just a tip, in the future, most artists will find it highly rude to see you respond in a way that basically says their time and effort isn't worth anything (points, cash, or otherwise). You wouldn't ask someone to paint your house for free, would you? Creating anything, including a drawing, takes a lot of time, money, and effort; it's only natural to want compensation for something you would spend hours working on for someone else.

I recommend being upfront and asking the artist if they take requests. On default, most professional artists do not, so don't take it as a personal offense if they say no, and remember that it's quite rude to respond with any level of exasperation or disbelief (because that's the same as saying you don't think their work is worth it).

I apologize if I seem blunt, but this is really just some sincere advice. Take it as you will.

I love the colours you used, and how you shaded and highlighted Twilight Sparkle with lots of magentas, purples and blues instead of using the dodge/burn tool. The effect is amazing, and the aura and sparks have a lot of personality. So do the little twinkles - I can tell that they are hand-painted instead of just plopped on using a Photoshop brush, because each one looks different. You did a really good job with this painting!

Oh, and I was linked to this picture from a journal entry about deviantart tolerating tracing and stuff. I really wish they wouldn't force artists to do these DMCA complaints. Why can't they just flippin' do their job instead of making us work harder to protect our art?

One thing I notice is that you do not say 'do not trace/copy/reproduce etc' in your artist comments. I have read that if you do not specifically say this then your art is fair game as far as DA is concerned. I have never had my art stolen (not surprisingly as I usually use bases and the stuff I do draw is not worth stealing) so I can not tell you from personal experience, but from what I have read from other journals on this site it is advisable to state your rights on anything you post, and actually tell people that they may not us your work in any way.

USA and DA's copyright policy states works of art don't need an explicit copyright brand - that means it doesn't need the (c) logo, nor does it need to have anywhere near or on the work that it cannot breach copyright policy. This means you don't need to brand every work you have with a long list of "do not use for...".

Just like you don't need tags on every item in a store that says "do not take without paying". It's against the law to steal - copyright is the law against theft of art, and does not need to have disclaimers to protect it.

My capitalizing isn't yelling, I just need to get some things pointed out.

 You sir/ma'am are just not getting the point.

SHE OWNS THE ART ITSELF, NOT THE POSE(well, maybe), BUT THE ENTIRE ART PIECE ITSELF. THATS WHAT WE ARE SAYING TO YOOOUUU.

 

THE POINT in all of this is that someone TRACED her art. TRACING ART THEN CLAIMING IT AS YOUR OWN IS ILLEGAL AS HELL.

Get it through your skull and stop trying to say "Oh its okay, to trace someone's hard work."

ITs different. If you put this picture on a canvas then trace it line for line, that's tracing.

Referencing is OKAY, as long as credit is given. In References there is a difference from the original photo to your art, there should be nothing similar only that you wanted to see how another artist did the pose.

Tracing is when a lazy ass decides they don't want to learn how to draw that pose. When you trace someone else's artwork, you trace their style that they have tried to find for years. Its an oddly painful thing to see shit like this. Even if its not me, I can only imagine how Zill feels.

 

Im sorry for my language but JESUS, just understand that her work WAS TRACED. HER STYLE WAS TRACED. THE LINES WERE TRACED, LINE FOR LINE. THE POSE COULD BE SIMILAR TO SOMEONE ELSES, BUT DID THAT PERSON NEED TO TRACE HER WORK? FUCK NO THEY DIDNT. THEY COULD HAVE LIGHTLY REFERENCED (of course if she allowed it) TO SEE HOW SHE AS AN MLP ARTIST WOULD DO THAT POSE.

And the thing that would piss anyone off is, she declined them the first time. Yet they ignored her declining and went on to do their dirty work.

 

Now tell me, if someone did this to you, you wouldn't be a tad bit mad and ask them to credit you somewhere in the image.

Or if they didn't ask you and you just happen to see the same pose, you wouldn't just cringe a bit with possessiveness and check that art work to see, if its close to yours. And if it is you may or may not just point that out.

 

I truly am sorry for swearing, im trying not to sound rude. But damn.

My comment is not against Zillenioise, whom i respect, but something general that concerns most artists.
I'm not firing anyone and i don't moraly judge people cause i don't care that much about morality.
And it seems to me that both parties in this little conflict have been, at the end, cool to each other.
Again what i say (that is just my 2 cents anyway) is general.

The fact is that TOO MANY people do not understand Copyright at ALL. And their ignorance feeds the system. They don't know what is it for, where it comes from, why, what are the limits and founded challenges...

I mean... if you think that copyright is just "that thing that garantee me that my art is my property" you got it all wrong and better go open a book or two.

No, copyright is not against theft.

 At least, this is not the nevralgic center of copyright but the logical outcome of copyright's main goal. There is in my opinion a big difference. Stop nourishing fear. There has been enough totalitarism in this world.

What surprises me is that Zilleniose seems to know a thing or two about copyright in general and still uses such strong and inappropriate words as "theft" and "steal". No, what I-don't-know-who did was not theft. It was an infrigment though. But please, don't use words like "steal". Even US law do not. You know that communism is still vivid in some countries, right ? It's not because the mainstream ideology is so popular that it must be the only only valuable or even a good one. Zilleniose seems to have an interest in intellectual property stuff. Good thing. But then i suggest her/him to do it in the right way and not to fall into the diagonal, soft, and (very) selective reading. 

Well watever, back to business.

Artists are being too  paranoid, and dive ridiculously  into the "hey that's mine !! whatcha doin' !!" childish thing like robots without even asking themselves if they actually have a factual problem with it. (not all artist though, some actually have good reasons not to let you use their art and everyone should respect that). They don't ask themselves "is it a problem for real ?" but instantly take for granted that  "it is considered a problem. Then it is."

What's funny is that most artist do not even realise that they are the biggest copyright infriger out there. Fan art is not legal. The piece of art above is not legal (it is just tolerated as long as it doesn't cross the line of free advertising for Hasbro to fall into something like "unfair competition" or loss of profit. Hasbro are not good guys  www.dailydot.com/business/hasb… (there ain't bad neither) they're just using Zilleniose as a mere cheap tool as we all do with everyone without even realising it (otherwise they must be very bipolar guys. cause seeking respect of the law in one hand, and closing your eyes in another is nothing but opportunism)

And it is not legal (i'm no longer talking 'bout Hasbro) to sue someone for something that itself is not legal. If someone actually traced zilleniose's art, the later legally don't have a single word to say (at least in my country). And Zilleniose's art can hardly be copyrighted cause it is merely impossible to separate his/her original elements from Hasbro's.

Sure, and sure again, that person should have credited the appropriate people.

But be a little cartesian about it and you'll find that, it's just a matter of ego and narcisim.

There is no actual harm (or i fail to find a consistent one as the above picture was freely and publicly displayed. That Zilleniose is not a big corporation with a wide audience neither is the infriger).

Is this the world that we want to live in ? A word of stupid and unfonded restrictions ?
